The recognition of Italian citizenship is subordinated to the demonstration, by the interested party, that their ancestors in a straight line have maintained Italian citizenship without interruption.

Who has access to Italian citizenship?

All those who can access it via descent, naturalization and marriage with a citizen.

Italian citizenship is based on the “ius sanguinis” principle, according to which a child born to an Italian father or an Italian mother is Italian;

  • Through the paternal line: citizenship is transmitted from father to son without generation limits.
  • By maternal line: the transmission of citizenship is possible only for children born after January 1, 1948 (date of entry into force of the Italian Constitution).
  • In both cases generation jumps are not allowed;

When the daughter or son of the first woman in the line of descent was born before 01/01/1948, in such a case we must request the recognition of citizenship by judicial means through a trial in the Italian courts of Rome, This procedure can only be carried out by lawyers in Italy, once the court ruling is received, then the recognition of citizenship is carried out.

Naturalization is the legal act by which the right of citizenship is granted to a foreigner. According to the Law of February 5, 1991, Italian citizenship can also be granted to foreigners who have had a legally maintained stay in that country.

The spouse, foreigner or stateless person, of an Italian citizen can acquire Italian citizenship when, after the marriage, they have legally resided for at least two (2) years in the territory of the Republic, or after three (3) years from the date of marriage The Italian citizen must also be registered in the Register of Italian Citizens Residing Abroad (AIRE, for its acronym in Italian). In addition, the spouse who is applying for citizenship must have a B1 level in Italian according to the Common European Framework of Reference for Languages.

Where can I do my citizenship?

At any Italian consulate or in Italy.

Citizenship via consulate: You need to have a minimum period of residence of 12 months, in addition you will have to present a recent bill of a service (telephone, electricity, internet, etc.) in the name of the person who will present the procedure.

Citizenship in Italy: The interested party must prove legal residence, either by study visa, work visa, tourist visa (90 days within the European community) or any other valid visa. The steps to follow will be the following:

Make declaration of presence in the Questura.

Fiscal Code processing.

Signing of the rental contract or transfer of residence by an authorized person, either in any of the two ways described above, you will proceed to go to the relevant commune to register as a legal resident.

After being registered in the commune, the “vigile comunale” will verify that the person is actually residing at the address they declared, once everything is verified, they will be registered as a resident of said commune

Presentation of the documentation in the “ufficio cittadinanza” of said commune. (Attention, some common ones usually have a shift reservation system, others are by order of arrival).

If the documentation is presented in Italy, it must have the Hague apostille, but not if it is presented at the Italian consulates.

What documentation is necessary to carry out the procedure?

• Original birth certificate indicating paternity and maternity, with the official’s stamp and signature.

• Marriage certificate, if married in Argentina (if the relative is married in Italy and a copy of the marriage certificate is not available, it is necessary to know at least the place and date of the marriage);

• Death certificate (if deceased) or valid ID;

• Certificate of the National Electoral Chamber: this is a certificate that attests if (and when) the Italian ancestor acquired Argentine citizenship.

It is necessary that the certificate contains all the names in Italian and Spanish (for example: Giovanni Battista / Juan Bautista) and the variations that the name and/or surname have suffered over time, which are dazzled in the civil status records (eg Callegar/Calegari; Eristo/Evaristo).
If the Certificate is positive, it must contain the date of “oath” or the date of “granting of the letter of citizenship.”

In the absence of said data, it will be essential to present the “naturalization sentence”, without which, by indication of the Ministry of the Interior, it will not be possible to complete the citizenship recognition process.
